These Terms & Conditions apply to services provided by Oliver James Landscapes Limited.

1. Our services

Oliver James Landscapes Limited provides garden maintenance and soft landscaping services.

Our services may include:

  • Garden maintenance

  • Lawn mowing and care

  • Hedge cutting

  • Planting

  • Turfing

  • Pruning

  • Garden clearance and general garden maintenance

  • Fencing

  • Garden timber work

  • Other horticultural and landscaping services agreed with the customer

The specific work to be carried out will be set out in the relevant quotation.

2. Quotations

Quotations are based on the information and site conditions reasonably available to us when the quotation is prepared.

Unless otherwise stated, quotations are valid for 30 days.

If the scope of work changes, or circumstances arise that could not reasonably have been identified when preparing the quotation, we may need to revise the quotation.

Where reasonably practicable, we will discuss any additional costs with the customer before carrying out additional work.

3. Scope of work

We will carry out the work described in the agreed quotation.

Work that is not included in the agreed scope may be charged separately.

If additional work is requested during a project or maintenance visit, we may provide an additional quotation or agree an additional charge before carrying out the work.

4. Site access

Customers must provide reasonable access to the property at the agreed times.

Customers should inform us in advance about any circumstances that may affect our ability to access or safely work at the property, including:

  • Locked gates

  • Parking restrictions

  • Alarm systems

  • Pets

  • Restricted areas

  • Other access restrictions

If we are unable to gain reasonable access to the property when a visit has been arranged, the visit may be chargeable to the customer.

Where access cannot be gained, we will make reasonable efforts to contact the customer and, where appropriate, arrange another visit.

5. Plants, turf and natural materials

Plants, turf and other living materials are affected by factors outside our control, including weather, soil conditions, pests, disease, watering and ongoing care.

Unless expressly agreed otherwise in writing, we cannot guarantee the long-term survival or establishment of plants or turf.

We will take reasonable care when selecting and installing plants and materials in accordance with the agreed specification.

6. Customer responsibilities

Customers are responsible for providing accurate information that may affect the work.

This includes informing us of any known:

  • Underground pipes or cables

  • Drainage systems

  • Irrigation systems

  • Septic tanks

  • Protected areas

  • Access restrictions

  • Other relevant site conditions or hazards

Customers should provide this information before work begins.

7. Payment

Unless otherwise agreed in writing, invoices are payable within 7 days of the invoice date.

For regular garden maintenance services, invoices are issued at the end of each month, with payment due within 7 days of the invoice date.

We reserve the right to suspend or postpone further work where invoices remain unpaid.

8. Additional work

Additional work outside the agreed scope may incur an additional charge.

We will normally obtain the customer’s agreement before carrying out chargeable additional work.

Where an urgent issue arises and it is not reasonably practicable to obtain prior approval, we will communicate with the customer as soon as reasonably possible.

9. Cancellation and postponement

If you need to cancel or rearrange an agreed visit, please provide as much notice as reasonably possible.

Any specific cancellation terms or charges applicable to a particular service will be stated in the relevant quotation.

We reserve the right to charge reasonable costs resulting from late cancellation where this has been agreed with the customer.

10. Standards of service

We will carry out our services with reasonable care and skill.

Nothing in these Terms & Conditions is intended to remove or restrict any statutory rights that apply to customers.

11. Complaints

If you are unhappy with any aspect of our service, please contact us as soon as reasonably possible.

We will review the matter and, where appropriate, discuss reasonable steps to resolve the issue.

12. Photographs

We may take photographs of gardens and completed work for our records.

We may use photographs for our website, portfolio or marketing purposes where appropriate permission has been obtained.

We will take reasonable steps to avoid publishing identifiable photographs of customers or other individuals without their permission.

13. Website information

We take reasonable care to ensure that information provided on our website is accurate and up to date.

Photographs on our website show examples of our work and are not intended to guarantee that every project will produce an identical result.

Natural materials, plants, weather conditions, site conditions and other circumstances mean that individual projects may differ.

14. Liability

Nothing in these Terms & Conditions is intended to exclude or restrict any liability or statutory right that cannot lawfully be excluded or restricted.

Subject to this, we will not be responsible for loss or damage arising from circumstances outside our reasonable control.

15. Circumstances beyond our control

We will not be responsible for delays or failure to carry out our services where this results from circumstances beyond our reasonable control.

This may include extreme weather, natural events, emergencies, serious access restrictions, utility failures or other unforeseen circumstances.

16. Governing law

These Terms & Conditions are governed by the laws of England and Wales.

Any disputes will be subject to the jurisdiction of the courts of England and Wales, subject to any applicable consumer rights.
